1. Qué cubren

Estas condiciones rigen los servicios de diseño y publicación de páginas web (plan Web Express) y de configuración y gestión de campañas publicitarias en Facebook e Instagram (planes Web + Campaña y Campañas) que presta ASTRC (los «Servicios»). ASTRC es la marca comercial operada por la persona identificada en el punto 1 de los Términos y condiciones. El software ASTRC Business se rige por esos Términos, no por estas condiciones.

2. Cómo se contrata

  • El cliente puede contratar un plan publicado pagándolo en línea en astrc.com.co, o pedir antes una propuesta. En ambos casos, ASTRC le confirma por escrito (WhatsApp o correo) el plan, el precio, lo que incluye y el plazo estimado (la «Propuesta»). Al pagar o al aceptar la Propuesta, el cliente acepta también estas condiciones. Si la Propuesta dice algo distinto, prevalece la Propuesta.
  • Pago en línea: con tarjeta, procesada por Tilopay (ASTRC no ve ni guarda los datos de la tarjeta), o con SINPE Móvil, en dólares o en colones.
  • Los precios están en dólares más IVA (13 %). Se pueden pagar en colones al tipo de cambio de venta del Banco Central del día del pago. ASTRC emite factura electrónica por cada pago.
  • Los precios publicados son precios de entrada («desde») y corresponden al alcance básico de cada plan. Lo que el cliente necesite además se cotiza en la Propuesta antes de cobrar.
  • Lo que no esté en la Propuesta (funciones adicionales, páginas extra, fotografía, redacción extensa, tiendas en línea, etc.) se cotiza aparte antes de hacerlo.

3. Páginas web

  • Lo que aporta el cliente: logo, fotos, textos, servicios, precios y datos de contacto. El plazo de entrega empieza a contar cuando ASTRC tiene esa información completa; las demoras en recibirla mueven la fecha de entrega.
  • Ajustes: antes de publicar, el cliente revisa la página y puede pedir hasta dos rondas de ajustes dentro del alcance contratado. Si en 30 días naturales desde que ASTRC entrega la versión para revisar el cliente no pide ajustes ni la aprueba, se tiene por aprobada.
  • Pago: el 50 % al contratar y el 50 % al entregar. Al aprobar el cliente la página, ASTRC le manda el enlace de pago del saldo. La página se publica en su versión final cuando el pago está completo.
  • Publicación y alojamiento: la publicación inicial está incluida. La Propuesta indica dónde queda publicada la página y, si lo hay, el costo de mantenerla en línea. Si la Propuesta no dice nada y la página queda en la infraestructura de ASTRC, ASTRC la mantiene publicada sin costo adicional al menos durante 12 meses desde la entrega y, antes de dejar de hacerlo, avisa con 30 días para que el cliente pueda llevársela.
  • Dominio: si el cliente quiere un dominio propio (.com, .cr, etc.), lo registra a su nombre y paga su costo y su renovación al registrador; ASTRC lo conecta. ASTRC no responde por la pérdida de un dominio cuya renovación no está a su cargo.
  • Propiedad: con el pago completo, el cliente es dueño del diseño y del contenido específicos de su página. ASTRC conserva la titularidad de sus herramientas, plantillas base, código genérico y conocimientos, que puede seguir usando. ASTRC puede mostrar la página como ejemplo de su trabajo, salvo que el cliente se oponga por escrito.

4. Campañas en Facebook e Instagram

  • Presupuesto de anuncios: el plan cubre la configuración y la gestión mensual de la campaña. Lo que se invierte en anuncios lo paga el cliente directamente a Meta Platforms, en la cuenta publicitaria del cliente y con su medio de pago. ASTRC no adelanta ni administra ese dinero y no responde por los cargos que Meta haga a esa cuenta.
  • Cuentas: la página de Facebook, la cuenta de Instagram, la cuenta publicitaria, el Píxel y las audiencias son del cliente. ASTRC trabaja con el acceso que el cliente le da y lo deja de usar al terminar el servicio; el cliente puede retirarlo en cualquier momento.
  • Aprobación de los anuncios: antes de publicar, el cliente aprueba los textos y las imágenes. Al aprobarlos confirma que lo que dicen es cierto (precios, promociones, plazos y condiciones) y que puede ofrecerlo. El anunciante frente al público es el cliente, que responde por su oferta conforme a la Ley N.° 7472. Si su actividad requiere permisos para hacer publicidad (por ejemplo, en salud o servicios financieros), obtenerlos le corresponde al cliente.
  • Meta: la publicación de anuncios depende de las políticas y decisiones de Meta, que ASTRC no controla. ASTRC no responde por rechazos de anuncios, restricciones o bloqueos de cuentas, cambios en los costos o en el funcionamiento de las plataformas, salvo que los cause un incumplimiento de ASTRC.
  • Resultados: ASTRC configura y optimiza las campañas con diligencia profesional, pero no garantiza una cantidad de ventas, mensajes, clics ni un costo por resultado, porque dependen también de Meta, del mercado, de la oferta y de la atención que el cliente dé a cada interesado.
  • Datos de los interesados: los datos de las personas que responden a los anuncios son del cliente, que es el responsable de su tratamiento conforme a la Ley N.° 8968. ASTRC los trata solo por cuenta del cliente y para operar la campaña. El cliente debe informar a los visitantes de su página sobre el Píxel de Meta y las cookies que usa; ASTRC puede darle un texto de referencia.

5. Planes mensuales, renovación y cancelación

  • Los planes Web + Campaña y Campañas se pagan por mes adelantado y se renuevan cada mes. No tienen permanencia mínima.
  • Al contratar un plan mensual con tarjeta, el cliente autoriza que la tarjeta quede guardada en Tilopay y que se le cobre el mismo monto cada mes, en la misma fecha, hasta que cancele. Si un cobro falla, ASTRC avisa y puede reintentarlo.
  • El cliente puede cancelar avisando por escrito antes de la fecha de renovación; ese mes ya pagado se completa y no se cobra el siguiente. No se reembolsan proporcionalmente los días de un mes ya iniciado.
  • Si un pago mensual no se hace, ASTRC puede pausar la gestión de la campaña hasta que se ponga al día; los anuncios que el cliente siga pagando a Meta quedan a su cargo.
  • En el plan Web + Campaña, si el cliente cancela antes de completar tres meses, la página queda pagada con lo abonado y es suya en los términos del punto 3.

6. Desistimiento y reembolsos

  • Antes de que ASTRC empiece a trabajar, el cliente puede desistir y se le devuelve todo lo pagado.
  • Una vez iniciado el trabajo con su autorización, lo pagado cubre el trabajo hecho. Si ASTRC no entrega lo acordado por causas que le sean imputables, devuelve lo pagado por la parte no entregada.
  • Los reembolsos se hacen por el mismo medio de pago; si eso no es posible, por SINPE Móvil o transferencia. Nada de esto limita los derechos irrenunciables que la Ley N.° 7472 otorga a quien tenga la condición de consumidor.

7. Contenido del cliente

El cliente garantiza que tiene derecho a usar los logos, fotos, textos, marcas y demás material que entrega, y que ese material y su oferta no infringen derechos de terceros ni la ley. El cliente responde frente a terceros por ese material y mantiene indemne a ASTRC de los reclamos que surjan de él. ASTRC puede negarse a publicar contenido que considere ilícito, engañoso o contrario a las políticas de las plataformas.

8. Responsabilidad

  • ASTRC presta los Servicios con diligencia profesional. En la medida que lo permita la ley, no responde por daños indirectos, lucro cesante ni pérdida de ventas, ni por lo que hagan Meta, el registrador del dominio u otros terceros.
  • En la medida que lo permita la ley, la responsabilidad total de ASTRC por un Servicio se limita a lo que el cliente pagó a ASTRC por ese Servicio en los tres meses anteriores al hecho que la origine.
  • Estas limitaciones no se aplican al dolo o la culpa grave de ASTRC ni limitan los derechos irrenunciables del consumidor.

9. Cambios, ley aplicable y diferencias

ASTRC puede cambiar estas condiciones; los cambios no afectan un Servicio ya contratado ni el mes en curso de un plan mensual. Se rigen por las leyes de Costa Rica. Las diferencias se intentan resolver primero de forma directa durante 30 días; si no se logra, quedan a salvo las vías de protección al consumidor y, en lo demás, son competentes los tribunales de San José. 1. What they cover

These terms govern ASTRC's website design and publishing service (Web Express plan) and its Facebook and Instagram advertising campaign setup and management service (Web + Campaign and Campaigns plans) (the "Services"). ASTRC is the trade name operated by the person identified in section 1 of the Terms and Conditions. The ASTRC Business software is governed by those Terms, not by these.

2. How to hire

  • The customer can hire a published plan by paying online at astrc.com.co, or ask for a proposal first. Either way, ASTRC confirms in writing (WhatsApp or email) the plan, price, what's included and the estimated timeline (the "Proposal"). By paying or accepting the Proposal, the customer also accepts these terms. If the Proposal says something different, the Proposal prevails.
  • Online payment: by card, processed by Tilopay (ASTRC doesn't see or store card details), or by SINPE Móvil, in US dollars or colones.
  • Prices are in US dollars plus VAT (13%). They can be paid in colones at the Central Bank's selling rate on the payment date. ASTRC issues an electronic invoice for each payment.
  • Published prices are starting prices ("from") and cover each plan's basic scope. Anything else the customer needs is quoted in the Proposal before charging.
  • Anything not in the Proposal (extra features, extra pages, photography, extensive copywriting, online stores, etc.) is quoted separately before doing it.

3. Websites

  • What the customer provides: logo, photos, texts, services, prices and contact details. The delivery timeline starts when ASTRC has that information complete; delays in receiving it move the delivery date.
  • Revisions: before publishing, the customer reviews the site and may request up to two rounds of revisions within the hired scope. If within 30 calendar days after ASTRC delivers the review version the customer neither requests changes nor approves it, it's deemed approved.
  • Payment: 50% when hiring and 50% on delivery. When the customer approves the site, ASTRC sends the payment link for the balance. The final version is published once payment is complete.
  • Publishing and hosting: initial publishing is included. The Proposal states where the site is published and, if any, the cost of keeping it online. If the Proposal says nothing and the site stays on ASTRC's infrastructure, ASTRC keeps it online at no extra cost for at least 12 months from delivery and, before stopping, gives 30 days' notice so the customer can take it elsewhere.
  • Domain: if the customer wants their own domain (.com, .cr, etc.), they register it in their name and pay its cost and renewal to the registrar; ASTRC connects it. ASTRC isn't liable for losing a domain whose renewal isn't its responsibility.
  • Ownership: once paid in full, the customer owns the specific design and content of their site. ASTRC keeps ownership of its tools, base templates, generic code and know-how, which it may keep using. ASTRC may show the site as an example of its work unless the customer objects in writing.

4. Facebook and Instagram campaigns

  • Ad budget: the plan covers the setup and monthly management of the campaign. Ad spend is paid by the customer directly to Meta Platforms, in the customer's ad account and with their payment method. ASTRC doesn't advance or manage that money and isn't liable for charges Meta makes to that account.
  • Accounts: the Facebook page, Instagram account, ad account, Pixel and audiences belong to the customer. ASTRC works with the access the customer grants and stops using it when the service ends; the customer may revoke it at any time.
  • Ad approval: before publishing, the customer approves the copy and images. By approving them they confirm what they say is true (prices, promotions, timelines and conditions) and that they can offer it. The advertiser toward the public is the customer, who is responsible for their offer under Law No. 7472. If their activity requires advertising permits (for example, in health or financial services), obtaining them is the customer's responsibility.
  • Meta: ad delivery depends on Meta's policies and decisions, which ASTRC doesn't control. ASTRC isn't liable for ad rejections, account restrictions or blocks, or changes in platform costs or behavior, unless caused by ASTRC's breach.
  • Results: ASTRC sets up and optimizes campaigns with professional diligence, but does not guarantee a number of sales, messages or clicks, or a cost per result, because they also depend on Meta, the market, the offer and how the customer handles each lead.
  • Lead data: the data of people who respond to the ads belongs to the customer, who is the controller under Law No. 8968. ASTRC processes it only on the customer's behalf and to run the campaign. The customer must inform visitors to their site about the Meta Pixel and cookies it uses; ASTRC can provide reference text.

5. Monthly plans, renewal and cancellation

  • The Web + Campaign and Campaigns plans are paid monthly in advance and renew every month. There's no minimum term.
  • When hiring a monthly plan by card, the customer authorizes the card to be stored with Tilopay and charged the same amount every month, on the same date, until they cancel. If a charge fails, ASTRC notifies them and may retry it.
  • The customer may cancel by giving written notice before the renewal date; the month already paid is completed and the next one isn't charged. Days of a month already started aren't refunded pro rata.
  • If a monthly payment isn't made, ASTRC may pause campaign management until it's brought up to date; any ads the customer keeps paying Meta for are the customer's responsibility.
  • In the Web + Campaign plan, if the customer cancels before completing three months, the website is considered paid with what was paid and is theirs under section 3.

6. Withdrawal and refunds

  • Before ASTRC starts working, the customer may withdraw and everything paid is refunded.
  • Once work has started with their authorization, what was paid covers the work done. If ASTRC doesn't deliver what was agreed for reasons attributable to it, it refunds what was paid for the undelivered part.
  • Refunds are made through the same payment method; if that isn't possible, by SINPE Móvil or bank transfer. None of this limits the non-waivable rights Law No. 7472 grants to anyone who qualifies as a consumer.

7. Customer content

The customer warrants they have the right to use the logos, photos, texts, trademarks and other material they provide, and that this material and their offer don't infringe third-party rights or the law. The customer is responsible toward third parties for that material and holds ASTRC harmless from claims arising from it. ASTRC may refuse to publish content it considers unlawful, misleading or contrary to platform policies.

8. Liability

  • ASTRC provides the Services with professional diligence. To the extent permitted by law, it isn't liable for indirect damages, lost profits or lost sales, or for the acts of Meta, the domain registrar or other third parties.
  • To the extent permitted by law, ASTRC's total liability for a Service is limited to what the customer paid ASTRC for that Service in the three months before the event giving rise to it.
  • These limitations don't apply to ASTRC's willful misconduct or gross negligence, nor do they limit consumers' non-waivable rights.

9. Changes, governing law and disputes

ASTRC may change these terms; changes don't affect a Service already hired or the current month of a monthly plan. They're governed by the laws of Costa Rica. Disputes are first addressed directly for 30 days; if unresolved, consumer protection channels remain available and, otherwise, the courts of San José have jurisdiction.
